1. Eligibility; Automatic Delivery; Sole Supply.
The Plan is available only for the Covered Equipment at the Service Address while Customer remains enrolled in Supreme Oil Automatic Delivery under a separate Automatic Delivery Agreement. During the Contract Term, Customer will purchase heating oil for the Service Address exclusively from Supreme unless Supreme authorizes otherwise in writing. The Plan is priced for accounts expected to use approximately 1,000 gallons or more annually. A shortfall caused solely by ordinary weather or normal usage does not automatically create a $500 charge; Supreme may review future eligibility or renewal pricing. Customer must promptly report material usage, occupancy, equipment or alternate-heat changes.
2. One Plan = One Covered Burner / Unit; Qualification.
This Agreement covers exactly one identified oil burner/heating unit shown in the Covered Equipment Schedule; it is not whole-house coverage. Each additional separately fired burner or heating unit requires its own Service Plan and price. Supreme may require photographs, equipment identification, inspection and correction of unsafe or unsuitable conditions before acceptance or continued coverage, and may accept coverage subject to specifically documented exclusions.
3. Pre-Existing Conditions.
Coverage applies to eligible failures occurring after Supreme accepts the Covered Equipment. Supreme is not required to repair or replace a defect, deterioration, malfunction, unsafe condition, leak, corrosion, rust, contamination, improper installation, prior damage or other condition existing before acceptance, whether or not it had already caused complete failure. Pre-existing conditions may be documented by photographs, inspection/service records or customer disclosures.
4. Annual Preventive Maintenance; April 1-August 31.
The Plan includes one annual cleaning/tune-up for the Covered Burner / Unit during Supreme's Annual Maintenance Window, April 1-August 31, subject to scheduling availability. Customer is responsible for requesting the appointment early enough to obtain a date in that window. Maintenance may include standard burner service, accessible combustion-area/chimney-base cleaning, up to five feet of safely accessible flue pipe, combustion check/adjustment and the annual consumables in Section 5. Requests September 1-March 31 are subject to emergency priorities and are not guaranteed. If Supreme agrees to a peak-season tune-up, a $150 Peak-Season Maintenance Fee applies. A new heating-season customer may activate an accepted Plan without an immediate tune-up; if unavailable, maintenance will be scheduled in the next April-August window.
5. Annual Consumables; Covered Parts.
The annual tune-up allowance includes no more than one nozzle, one oil filter/filter cartridge and one oil strainer per Contract Term for the Covered Burner / Unit; those installed during the tune-up use that yearly allowance. Subject to exclusions and model limits, covered repair parts are: single aquastat (L4006A1959 only); cad cell eye/holder; single cad cell relay; ignition porcelain/electrodes; electronic oil igniter (B51771U only); ignition wires; oil burner coupling; single-stage A2VA oil burner pump; and one toggle switch per term. Obsolete, discontinued, unavailable, incompatible or unlisted parts are not covered unless Supreme agrees in writing.
6. Exclusions.
Unless expressly stated otherwise, the Plan excludes repair/service labor outside the included annual maintenance; multi-function controls/relays; double/triple aquastats; zone valves; circulators; check valves; thermostats; special controls; low-voltage/network/Wi-Fi equipment; sludge, water or contamination; clogged/frozen oil lines; plumbing leaks; air-conditioning components; heat exchangers; blowers/air vents; low-water-cutoff failure; draining/purging/bleeding; tanks, supports, fill/vent piping, oil lines, buried piping, chimney/flue structural repairs and electrical supply; damage from fire, flood, freezing, power problems, weather, misuse, neglect, improper installation, unauthorized alteration or work by others; Pre-Existing Conditions; and non-standard/obsolete burners unless specifically accepted.
7. Troubleshooting & Safety.
Before a non-emergency service request, Customer is encouraged to use Supreme's troubleshooting portal/videos and perform only safe basic checks: thermostat, emergency switch, breaker/fuse and tank gauge/fuel level. A burner reset should be pressed no more than once where safe and appropriate. If there is smoke, fire, strong fuel odor, visible leak, carbon-monoxide alarm or another dangerous condition, stop troubleshooting and contact appropriate emergency services and Supreme.
8. Priority Emergency Service; No Guaranteed Arrival Time.
Active Plan customers receive priority scheduling for qualifying no-heat and heating-system emergency calls. Supreme may prioritize based on safety, complete versus partial heat loss, outside/indoor temperature, outage duration, special circumstances, routing/travel conditions, technician availability and other emergencies. Supreme will use reasonable efforts to respond promptly, but no technician arrival time is guaranteed. Severe weather, snow/ice, road closures, unsafe access, power outages, extraordinary call volume, parts/vendor shortages and other conditions beyond Supreme's reasonable control may delay service. Customer must promptly report changed conditions.
9. Non-Covered Work; Labor Rates; Authorization.
Repair/service labor outside included annual maintenance is generally billable. Regular Business Hours are Monday-Friday, 8:00 a.m.-5:00 p.m., excluding designated holidays, at $275/hour with a two-hour minimum ($550). After Hours - evenings, overnight, weekends and designated holidays - are $385/hour with a two-hour minimum ($770). Parts, materials, applicable taxes and authorized travel/special-order costs are additional. Where practical, Supreme will disclose the nature and estimated or not-to-exceed amount for non-covered work before performance. Customer may authorize work in writing, electronically, by recorded service communication or verbally in an emergency when written authorization is not practical.
10. Customer Responsibilities; Safe Access.
Customer will maintain safe, reasonable access to the driveway, fill pipe, tank, boiler/burner room and Covered Equipment, including snow/ice removal and control of pets, gates, locks and other hazards; maintain a reasonably functional tank gauge and required electrical power; provide accurate contact/access/occupancy information; promptly report abnormal usage, alternate heat, equipment changes, vacancy, power loss, gauge issues or delivery obstructions; avoid repeated reset-button use and unsafe repairs; and take reasonable steps to protect the property during a heat interruption while awaiting service.
11. Automatic Delivery, Run-Outs & Delivery Access.
Automatic Delivery reduces run-out risk but is not a no-run-out guarantee. Delivery scheduling, access duties, delivery-refusal/unsuccessful-delivery charges, nonpayment delivery holds and related delivery obligations are governed by Customer's Automatic Delivery Agreement. A run-out or service need caused by abnormal/changed usage, alternate heat, customer nonpayment, blocked/unsafe access, snow/ice, road closure, power loss, nonpayment/account hold, delivery refusal, faulty/inaccurate gauge or Customer's failure to provide required notice is not covered service and may be billed.
12. Customer-Owned Tanks, Piping & Site Conditions.
Customer is responsible for the condition, maintenance, integrity, code compliance and safe operation of customer-owned tanks, supports, fill/vent piping, oil lines, boiler/furnace structure, chimney/flue, plumbing, electrical systems and other site equipment. The Plan is not tank insurance and does not guarantee against leakage or failure. Supreme is not responsible for loss caused by defects, corrosion, leakage, deterioration, improper installation, contamination or failure of customer-owned equipment/site conditions, except to the extent directly caused by Supreme's negligence. Nothing waives gross negligence, willful misconduct or a non-waivable duty.
13. Outside Contractors.
Supreme is the authorized service provider for the Covered Equipment during the Contract Term. Unauthorized outside work may exclude the affected condition, component or resulting damage, and Supreme need not reimburse outside-contractor charges. A genuine emergency may be handled by another qualified provider when Supreme authorization is not reasonably obtainable; Customer should notify Supreme promptly. Outside work does not automatically void unrelated Plan coverage.
14. Early Termination; Service Plan Benefit True-Up.
The $425 Plan price reflects Customer's Automatic Delivery and sole-supply commitment for the Contract Term. If Customer voluntarily cancels the Plan before expiration, cancels required Automatic Delivery, purchases heating oil from another supplier, terminates the required Supreme fuel relationship or materially breaches the Plan resulting in early termination, Supreme may perform a Service Plan Benefit True-Up. The True-Up equals documented standard retail value of Plan benefits actually provided during the current term - including annual maintenance, Covered Parts, waived/included benefits or other specifically documented Plan value - less the Plan price actually paid and amounts separately paid for the same item. Values must come from Supreme's standard retail/service pricing in effect when provided and be supported by records. No item or loss is counted twice. The additional True-Up will not exceed $500 and is intended to reimburse unrecovered Plan benefits, not punish Customer. No True-Up applies solely because ordinary weather/normal usage results in less than 1,000 gallons while Customer otherwise complies, or because of a qualifying transfer under Section 15.
15. Sale of Property / Transfer to New Owner.
If Customer sells the Service Address before expiration, the unused remainder of the current term may be transferred to the purchaser for the same Service Address and accepted Covered Equipment. Transfer creates no cash/refund value and does not extend the original Expiration Date. Seller remains responsible for prior balances and must notify Supreme. The new owner must establish a Supreme account, provide current contact/payment information, accept applicable Plan terms, enroll in Automatic Delivery and permit inspection if requested. Existing pre-existing-condition exclusions and equipment limitations remain.
16. Suspension or Termination by Supreme.
Supreme may suspend or terminate the Plan for material nonpayment, material misrepresentation, unsafe equipment/site conditions, repeated denial of required access, unauthorized alterations materially affecting coverage, outside fuel purchases, cancellation of required Automatic Delivery or other material breach. Where reasonably appropriate, Supreme may allow an opportunity to cure. Suspension/termination does not eliminate amounts already due. If Supreme terminates for reasons not caused by Customer's material breach, no early-termination Benefit True-Up applies.
17. Automatic Renewal & Non-Renewal.
The Effective Date is the date Customer electronically signs this Agreement; the Expiration Date is system-calculated 365 days later. Subject to Customer's separate affirmative automatic-renewal consent and applicable law, the Plan may renew for successive 12-month terms unless Customer elects not to renew. Supreme will provide legally required renewal notice, renewal price/pricing method, material-change disclosures and cancellation instructions within the time and by the method required by New York law. Non-renewal stops the next Plan term; it does not cancel the current term or eliminate existing balances. Renewal of this Service Plan does not renew or create any Fixed Price, Cap, Pre-Buy, protected-gallon or commodity-price commitment.
18. Plan Price; Taxes; Credit-Card Pricing.
The base Plan price is $425.00 per Covered Burner / Unit. Applicable sales tax is added. Current displayed pricing is: sales tax $35.59; Standard Total $460.59; Credit-Card Total Price (if applicable) $476.72. Supreme will display the total amount due before payment. Except as required by law, the Plan price is non-refundable after the Plan becomes effective and Plan benefits are made available. If Supreme terminates without Customer material breach, Supreme may issue an appropriate refund or credit based on the circumstances.
19. Service, Dispatch & Account Records.
Supreme may use ordinary business records to administer the Plan, determine coverage and document charges, including GPS/dispatch data, technician time/service notes, photographs, CRM/account records, delivery meter records, portal submissions, emails, texts, lawfully retained call records, customer authorizations and invoices. Customer may request an itemized explanation of a disputed Plan charge. Supreme will preserve the accepted contract version, signer identity and acceptance date/time in the ordinary course of its records.
20. Delays; Other Agreements; New York Law.
Supreme is not in breach solely because performance is delayed or prevented by conditions beyond its reasonable control, including severe weather, snow/ice, unsafe roads/access, governmental restrictions or closures, power outages, extraordinary call volume, labor/equipment disruptions and vendor/parts shortages; Supreme will use reasonable efforts to resume or provide service as conditions permit. This Service Plan governs service coverage for the Covered Equipment; the Automatic Delivery Agreement governs delivery scheduling and automatic-delivery obligations; Fixed Price/Cap/Pre-Buy agreements govern their own price, gallons, term and commodity-risk provisions. The more specific agreement controls the subject it specifically addresses and no provision permits duplicate recovery for the same loss. New York law governs. If a provision is unenforceable, the remainder remains effective to the fullest extent permitted by law. Material amendments apply prospectively and will be communicated as required by law. Electronic signatures and records may be used to the extent permitted by law.
